Terms of Service

Effective Sep 28, 2026Covers webinars, consults, Powder Phone

The deal when you join a webinar, book a trip consult or subscribe to the Powder Phone. It's written as plainly as we could make it.

01Agreeing to these terms

These terms are an agreement between you and Luke Stone ("Luke," "we," "us"). They cover our webinars, 1-on-1 trip consultations, The Powder Phone text subscription, and the pages and forms used to sign up for them (together, the "Services"). By signing up, booking or paying, you agree to these terms and to our Privacy Policy. You must be at least 18, or have a parent or guardian agree on your behalf.

02Forecasts are not guarantees

Please read this one

Weather is uncertain, and mountains are dangerous. Our forecasts, picks, tips and trip advice are Luke's best professional judgment at the time, and conditions change. We don't guarantee snowfall, conditions, road or lift status, crowds, or any result from a trip you plan with our help.

Nothing we share is avalanche, safety, medical, travel-booking or financial advice. Skiing and snowboarding, especially off-piste and in the backcountry, carry serious risk of injury and death. You're responsible for your own decisions, training, equipment, and for checking official avalanche forecasts, resort reports, road closures and local rules before you go. Travel bookings, cancellations and costs are your responsibility.

Program
The Powder Phone by Luke Stone
What you get

How often
About 2 texts per week (Sunday and Wednesday), plus account and billing notices. Frequency may vary with the weather.
Cost
Your pass price. Message and data rates may apply from your carrier.
Stop
Reply STOP to any text to unsubscribe. You'll get one message confirming it.
Help
Reply HELP to any text, or email [email protected]

By checking the consent box, you agree to receive recurring automated text messages at the number you provided. Consent is required to receive The Powder Phone, because the texts are the product. Texts are one-way updates; replies other than STOP and HELP may not be read. Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and coverage, and texts may not reach some international numbers.

Replying STOP ends your texts but does not cancel a paid subscription. To stop billing, cancel as described in section 5.

04Payments and renewals

  • Powder Phone Monthly ($48) renews automatically every month until you cancel.
  • Powder Phone Annual ($459) renews automatically every year until you cancel. We'll remind you before each renewal.
  • Consults and paid webinars are one-time payments at the price shown when you book.

By buying a renewing pass, you authorize us to charge your payment method at each renewal at the then-current price. If a price changes, we'll tell you before your next renewal. Payments are processed by Stripe. Prices are in US dollars, and any taxes are extra where they apply.

05Cancellations and refunds

Monthly and Annual passes: cancel anytime by emailing us or using the link in your receipt. Cancellation stops future renewals, and your texts continue through the end of the period you've paid for. We don't give partial refunds for unused time.

Trip consults: you can reschedule. Refund requests are reviewed case by case. If we have to cancel and can't find a new time that works for you, you'll get a full refund.

If something went wrong, email us before disputing a charge with your bank. We'll make it right where we reasonably can.

06Trip consultations

Consults are held on Zoom and recorded so we can send you the replay. Please complete the intake form honestly, since Luke uses it to prepare. Luke chases storms for a living, so in winter a call may occasionally need to move when a storm lines up. If that happens, we'll contact you right away to pick a new time. Recommendations are advice only, and you make and pay for your own bookings.

07Webinars

Webinars may be recorded, and registrants may receive the replay. Your name and any questions or comments you share in the chat may be visible to other attendees and may appear in the recording. Outlooks shared in a webinar reflect the information available at the time and are subject to the forecast disclaimer above.

08Our content

The texts, webinars, recordings, slides, pages and other materials we provide belong to Luke Stone or our licensors. They're for your personal, non-commercial use. Please don't resell, republish, screenshot-and-post at scale, or forward Powder Phone texts to groups or channels, or use them to build a competing product. Telling a friend where it's snowing is fine. Sharing your subscription with a crowd is not.

09Using our services

Please don't misuse the Services. That means don't give false information, sign someone else up without their permission, try to break or overload our systems, or harass Luke or other attendees. We may suspend or end access for anyone who does, and when we end access for a breach of these terms, no refund is owed.

10Disclaimers and liability

The Services are provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. We don't promise the Services will be uninterrupted or error-free, or that any text will arrive at a particular time.

To the fullest extent the law allows, Luke Stone is not liable for any indirect, incidental, special or consequential damages, or for injury, property damage, travel costs or lost bookings arising from your use of the Services or reliance on a forecast. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. You agree to indemnify us against claims arising from your own activities in the mountains or your breach of these terms. Some places don't allow certain limits, so parts of this section may not apply to you.

11Governing law

These terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Salt Lake County, Utah, unless the law where you live gives you the right to bring it locally. If any part of these terms is found unenforceable, the rest still applies.

12Changes and contact

We may update these terms. The effective date at the top shows the latest version, and we'll notify subscribers of material changes before they take effect. Continuing to use the Services after that means you accept the update.
